How Texas, Florida and California register astrology businesses
Astrology business registration in Texas, Florida and California: LLC filing fees, seller's permit rules and local license steps, agency by agency.
What to take away
- Astrology business registration in Texas, Florida and California runs through three different agencies: the California Secretary of State, the Texas Secretary of State and the Florida Division of Corporations.
- California charges the highest LLC filing fee of the three, and adds a yearly minimum franchise tax that applies even in a loss year.
- Texas has no state LLC filing fee for most new entities, but a seller's permit is required before you charge for readings.
- Florida requires a local business tax receipt from the county or city, not just a state filing.
- Most cities in all three states want a separate local business license or registration on top of the state paperwork.
- You can file the state paperwork yourself; the money you save can go toward the readings you plan to sell.
Choosing a structure for an astrology business in three states
A chart reading practice is a service business. You sell time, interpretation and a written or spoken deliverable. Most readers start as sole proprietors and move to an LLC once revenue is steady.
A sole proprietorship needs no state filing. You report profit on Schedule C of your federal return, which the IRS explains in its guide to starting a business. The trade-off is personal liability: a client dispute over a reading can reach your personal assets.
An LLC separates the business from you. It costs more to set up and more to maintain, but it gives you a clean business bank account, a name you can protect in one state, and a liability shield that sole proprietors do not have.
A corporation is overkill for most readers. It brings a board, bylaws and double taxation unless you elect S-corp status, which only pays off at higher profit levels.
The choice matters because each state prices these structures differently. California charges by gross receipts. Texas charges almost nothing at the state level. Florida charges a flat annual report fee.
If you sell readings online to clients in other states, you generally register where you live and work, not where the client sits. Physical presence is what triggers most registration duties. A home office, a storage unit for books or a booth at a local fair can all count.
Pricing your services is a separate decision from registration. Our breakdown of birth chart reading cost covers what readers charge across states, which helps you set a rate before you pick a structure.
Every state in this guide also expects you to check federal requirements. USAGov keeps a plain-language small business hub that walks through permits, taxes and employer rules in one place.
California LLC filing fees and Secretary of State forms
The California Secretary of State handles business entity registration for astrology businesses in the state. You file Articles of Organization for an LLC or a Statement of Information for an existing entity through the Business Entities portal.
Filing fees are set by the Secretary of State and published on its fee schedule. The Forms, Samples and Fees page lists current amounts for each form, including the LLC articles and the biennial Statement of Information.
California also charges a minimum franchise tax on LLCs, separate from the filing fee. It applies every year the entity is registered, including years with no profit. That single rule is why some California readers stay a sole proprietorship longer than they otherwise would.
The Secretary of State publishes a Starting a Business Checklist that lists these steps in order, including the agencies outside its own office. Work from that checklist rather than from a forum post.
Service revenue from readings is generally not subject to California sales tax. Physical products are. If you sell a printed natal chart, a deck or a workbook, treat those sales as taxable and register accordingly.
Name rules are strict. Your LLC name must not be misleading, and it must include the words Limited Liability Company or an accepted abbreviation. A name like "Sacramento Psychic LLC" is fine. A name that implies a licensed profession is not.
Texas registration and seller's permit rules
Texas is the cheapest of the three states to register an LLC. The Texas Secretary of State charges a filing fee for a Certificate of Formation, and the amount is set by statute and posted on the agency's site.
A Texas LLC also pays no state franchise tax until it crosses the revenue threshold the Comptroller sets. Most single-reader practices stay under it for years. That combination, a low filing fee and no annual state tax at small scale, is why Texas astrology businesses often incorporate earlier than California ones.
A Texas seller's permit is the piece readers miss. The Texas Comptroller issues it, and it lets you collect and remit sales tax on taxable items. Readings are a service and are generally not taxable in Texas. Books, candles, crystals and printed charts are.
Apply for the permit through the Comptroller's online portal. You will need your EIN, your entity number if you have one, and a description of what you sell. There is no fee for the permit itself.
If you sell only readings, you may not need a permit at all. Confirm that in writing with the Comptroller before you skip it, because the answer depends on whether you bundle any physical item with the reading.
Texas cities add their own layer. Houston, Dallas, Austin and San Antonio each run a local registration or permit process for home-based businesses. Austin, for example, has historically required a home occupation permit for a business run from a residence.
A Texas reader who works from a rented office avoids most home-occupation rules but takes on commercial lease terms, insurance and a certificate of occupancy. That trade is worth pricing before you sign.
Florida registration and local business tax receipts
The Florida Division of Corporations registers LLCs and corporations. Articles of Organization are filed with the state, and Florida charges an annual report fee every year after the first.
The Florida Department of Revenue handles sales tax and issues an annual resale certificate. Readings are generally not taxable in Florida. Tangible goods are.
The step out-of-state readers miss is the local business tax receipt. Florida counties and cities issue it, and it is required before you operate a business at a physical location. In Miami-Dade, Broward, Orange and Hillsborough counties, the receipt comes from the county tax collector or the city, depending on where you sit.
A home-based reading practice usually needs the receipt too. Some counties exempt home occupations from the receipt but still require a zoning approval. Call the county tax collector's office and ask which applies to your address.
Florida also has a separate registration for anyone who wants to use a fictitious name. If you trade as something other than your legal name, file the fictitious name registration with the Division of Corporations.
Florida's annual report is not optional. Miss it and the state dissolves the entity, which means refiling and paying back fees. Put the deadline in a calendar the day you register.
Local business license requirements by city
State registration does not replace a city license. Almost every large metro in these three states runs its own business registration, and the rules differ enough that a statewide answer is useless.
The table below shows the general pattern. Confirm current amounts with the city because fees change with each budget cycle.
| City | Local requirement | Who issues it |
|---|---|---|
| Los Angeles, CA | Business tax registration certificate | Office of Finance |
| San Francisco, CA | Business registration certificate | Treasurer and Tax Collector |
| Houston, TX | General business permit, home occupation rules | City permitting office |
| Austin, TX | Home occupation permit for home-based work | Development Services |
| Miami, FL | Local business tax receipt | City or county tax collector |
| Orlando, FL | Local business tax receipt plus zoning approval | City or county |
A few patterns hold across all three states. Home-based businesses face extra scrutiny. Client traffic to a residence is often capped or banned outright. Signage is restricted. Parking rules apply.
If you read charts entirely online, say so on the application. Many cities treat an online-only practice with no client visits as a lower-risk category with a lower fee.
Zoning is the quiet blocker. A city can approve your license and still deny your home occupation if the address is not zoned for it. Check zoning before you sign a lease or file state paperwork.
Some cities also require a fire inspection or a certificate of occupancy for a commercial space. Budget time for both.
What each state agency requires before you sell readings
Each state splits the work across agencies. Knowing which office does what saves a wasted trip.
California: the Secretary of State registers the entity. The Franchise Tax Board collects the annual tax. The Department of Tax and Fee Administration handles sales tax on goods. Your city issues the business tax certificate.
Texas: the Secretary of State registers the entity. The Comptroller issues the seller's permit and collects franchise tax. Your city or county issues local permits.
Florida: the Division of Corporations registers the entity. The Department of Revenue handles sales tax. The county tax collector issues the local business tax receipt.
Federal requirements apply in all three. You need an EIN if you have employees, file certain returns or want a business bank account. The IRS spells out that step and the tax elections that follow on its own small business pages.
Advertising rules apply to how you describe your services. The Federal Trade Commission polices deceptive claims, and a reader who promises specific outcomes for every client is exposed. Describe what you offer, not what a client will get.
If you use celebrity charts in marketing, image and publicity rights matter. SAG-AFTRA and the U.S. Copyright Office both publish guidance on using a performer's name or likeness. Our directories of Taurus celebrities and Libra to Pisces celebrities show how to profile public figures without overstating what a birth time proves.
Birth times are the weak point in most celebrity astrology content. Note the source and the uncertainty. The same discipline applies to any personality framework you sell alongside readings, including enneagram types and the MBTI analysts approach to typing.
One last agency habit: keep every confirmation number. When a city inspector or a state auditor asks, the paperwork you filed two years ago is the only proof that matters.
Common questions
Do I need an LLC to sell chart readings in these states? No. A sole proprietorship is legal in all three. An LLC adds liability protection and a business name, at the cost of filing fees and annual reports.
Which state is cheapest for astrology business registration? Texas, for most single-reader practices. It has the lowest state filing cost and no franchise tax below the Comptroller's revenue threshold. California is the most expensive because of its annual minimum tax.
Do I need a seller's permit if I only sell readings? Usually not, since readings are a service. You need one in Texas and Florida once you sell physical goods such as books or printed charts. Confirm with the state revenue agency.
Is a local business license required if I work from home? In most large cities, yes, often as a home occupation permit or a local business tax receipt. Zoning approval may be required separately.
Can I register in one state and read for clients in another? Generally yes. Registration follows where you live and work. Some states may expect registration if you have a physical presence there, such as an office or a booth.
What happens if I skip the annual report? California and Florida both dissolve or penalize entities that miss filings. Reinstatement costs more than the original filing, so set a reminder the day you register.
